1. Ticket Purchase Agreement
1.1 All tickets must be purchased through our official website, approved
third-party booking partner, or in person when available.
1.2 A ticket grants participation for one (1) individual on the selected tour date and time.
1.3 Tickets are non-transferable to other individuals without contacting Dark Water Tours LLC for approval.
1.4 You are responsible for entering accurate contact information when booking your tour.
1.5 Booking is not confirmed until you receive a confirmation email or text
message.

2. Refund & Cancellation Policy
2.1 Customer Cancellations:

• Cancellations made 48 hours or more before the scheduled tour time are eligible for a full refund.

• Cancellations made within 48 hours of the tour start time are not eligible for a refund.

2.2 No-Show Policy:

• Participants who do not arrive for their booked tour, for any reason, will not be refunded.

2.3 Company Cancellations:

• Dark Water Tours LLC reserves the right to cancel a tour due to:

• Severe weather

• Unsafe conditions

• Guide emergency

• Low enrollment

2,4 If Dark Water Tours LLC must cancel, you will be offered:

• A full refund or

• The option to reschedule to another date

2.5 Refunds are issued to the original payment method only.

3. Liability Waiver & Assumption of Risk
By participating in any Dark Water Tours walking tour, you acknowledge
and agree:
3.1 You participate at your own risk.
3.2 Walking tours involve inherent risks including, but not limited to:

• Uneven sidewalks

• Curbs, steps, and street crossings

• Weather conditions

• Low lighting in evening tours

• Interaction with public spaces and crowds

3.3 Dark Water Tours LLC, its owners, employees, contractors, & partners are not liable for:

• Personal injury

• Accidental harm

• Loss or damage to personal property

• Any incidents caused by negligence of the Participant or third parties

3.4 By attending, you voluntarily assume all risks associated with participating in a walking tour.
3.5 Parents or guardians are responsible for supervising minors at all
times.

4. Behavior Expectations
4.1 Participants are expected to behave respectfully toward guides, other
guests, and the public.
4.2 Dark Water Tours reserves the right to remove any guest who is:

• Disruptive

• Intoxicated

• Harassing others

• Putting themselves or others at risk

4.3 No refund will be issued for removal due to misconduct.

5. Weather Policy
5.1 Tours operate in light rain, mist, heat, humidity, and cold.
5.2 In the event of severe or dangerous weather, tours may be cancelled
or delayed.
5.3 Participants are responsible for dressing appropriately for weather
conditions.
5.4 If Dark Water Tours LLC cancels due to unsafe conditions, participants
may choose a refund or free reschedule.

6. Photography & Media Consent

6.1 By participating, you grant Dark Water Tours LLC permission to:

• Photograph you

• Record video

• Use those images for marketing, social media, and promotional

• purposes

6.2 If you prefer not to appear in photos, please inform your guide upon
arrival and we will accommodate your request.
6.3 Participants may take their own photos during the tour as long as they
do not obstruct walkways or disrupt the experience.

7. Accessibility Disclosure
7.1 Dark Water Tours LLC aims to be as accessible as possible; however, the nature of downtown walking tours includes:

• Uneven sidewalks

• Brick paths

• Occasional curbs or steps

• Slight inclines

• Tight pathways

7.2 Some sections may be challenging for guests using:

• Wheelchairs

• Walkers

• Strollers

7.3 If you have concerns regarding accessibility, please contact us in
advance and we will happily provide route details and assistance.

8. Late Arrival Policy
8.1 Tours begin promptly at the scheduled time.
8.2 We recommend arriving 10 minutes early for check-in and instructions.
8.3 If you arrive late:

• The tour will not wait, out of respect for on-time guests.

• You may attempt to catch up, but the guide cannot leave the group.

• Late arrivals are not eligible for refunds or reschedules.

9.Alcohol Policy
9.1 Dark Water Tours operates within the City of Ocean Springs, where
limited open-container allowances apply in designated areas. Guests are
welcome to bring their own beverages as permitted by local laws, but it is
each guest’s responsibility to follow all city regulations regarding alcohol
possession and consumption while on the tour.
9.2 Guests must be 21+ to consume alcohol. Dark Water Tours reserves
the right to remove any guest who appears overly intoxicated, disruptive, or
unsafe.
9.3 Alcohol is allowed on the tour only in compliant containers and only
within the zones where open-container laws are valid. Once outside those
areas, guests must secure or dispose of any alcoholic beverages.
9.4 Dark Water Tours is not responsible for any citations or penalties
incurred for violating local alcohol regulations.
9.5 Disorderly or intoxicated behavior will result in removal without refund.

10. Agreement

By purchasing a ticket and/or attending a tour, you confirm that you:

• Have read these Terms & Conditions

• Understand the policies

• Agree to all rules, risks, and expectations

If you do not agree, please do not purchase or participate in a tour.
